Refund and Cancellation Policy

1. Scope

This Refund and Cancellation Policy applies to services provided by Sivaiah Technologies Inc., including websites, custom software, applications, hosting, maintenance, email setup, technical support, consulting, integrations, and related technology services.

This policy applies unless a separate written agreement, Statement of Work, order form, or service schedule states different refund or cancellation terms.

2. Custom Services

Many Sivaiah Technologies Inc. services are custom, project-based, or client-specific. These may include custom websites, software applications, web applications, mobile applications, integrations, automation work, design work, development work, hosting configuration, email setup, and consulting services.

Because these services require time, planning, technical work, and allocation of resources, fees paid for custom services are generally non-refundable once work has started.

3. Deposits

Deposits, retainers, setup fees, onboarding fees, discovery fees, planning fees, design fees, development fees, and other upfront payments are non-refundable once work has started, unless otherwise stated in a written agreement or Statement of Work.

A deposit may be used to reserve project time, begin planning, perform discovery, purchase or configure services, start design or development, or allocate technical resources.

4. Completed Work

There are no refunds for completed work, delivered work, approved milestones, performed services, used service periods, completed setup, completed configuration, completed consulting, or completed development.

If a client cancels a project before completion, the client remains responsible for paying for all work performed up to the cancellation date, including any approved or partially completed milestones.

5. Client Cancellation of Custom Projects

A client may request cancellation of a custom project by providing written notice to Sivaiah Technologies Inc.

If a custom project is cancelled, the client is responsible for:

  • all work performed up to the cancellation date;
  • all approved milestones;
  • all non-refundable deposits, retainers, setup fees, and onboarding fees;
  • any third-party costs, subscriptions, licences, tools, hosting fees, domain fees, email fees, plugin fees, software fees, stock assets, API fees, or vendor charges incurred for the project;
  • any committed costs that Sivaiah Technologies Inc. cannot reasonably cancel or recover.

Sivaiah Technologies Inc. may invoice the client for unpaid amounts owed as of the cancellation date.

6. Monthly Hosting, Maintenance, and Support Services

Monthly hosting, maintenance, and support services may be cancelled without advance notice unless a Statement of Work, service schedule, or written agreement states otherwise.

Cancellation will usually take effect at the end of the current paid billing period. Fees for the current billing period are non-refundable once the billing period has started.

Sivaiah Technologies Inc. is not required to provide a partial refund, credit, or prorated refund for unused days in a monthly billing period.

7. Annual, Prepaid, and Fixed-Term Services

Annual, prepaid, fixed-term, discounted, or bundled services are non-refundable once the service period has started, unless otherwise stated in a written agreement or required by applicable law.

If a client cancels an annual, prepaid, or fixed-term service early, Sivaiah Technologies Inc. is not required to refund unused time, unused support, unused hosting, unused maintenance, or unused service credits.

8. Third-Party Fees

Third-party fees are non-refundable once incurred. These may include, but are not limited to:

  • domain registration or renewal fees;
  • hosting provider fees;
  • email platform fees;
  • Microsoft 365, Google Workspace, or similar account fees;
  • software licences;
  • plugins, themes, templates, or extensions;
  • stock images, fonts, media, or design assets;
  • API, cloud, database, storage, security, analytics, or monitoring fees;
  • payment processor fees;
  • app store, platform, or marketplace fees.

Clients are responsible for all third-party fees incurred for their project or services, even if the client later cancels.

9. Refunds Where Sivaiah Technologies Inc. Cancels

If Sivaiah Technologies Inc. cancels a service and cannot provide the agreed service, Sivaiah Technologies Inc. may provide a refund for the portion of prepaid fees relating to services not performed, excluding:

  • completed work;
  • work already performed;
  • non-refundable deposits;
  • setup or onboarding fees;
  • third-party fees;
  • committed costs;
  • amounts owed by the client;
  • services already delivered or made available.

The amount and availability of any refund will depend on the services, project status, fees paid, and applicable written agreement.

10. Non-Payment and Suspension

Sivaiah Technologies Inc. may suspend, restrict, or terminate services if a client fails to pay invoices, subscription fees, hosting fees, renewal fees, third-party charges, or other amounts when due.

Suspension or termination for non-payment does not waive the client’s obligation to pay outstanding amounts.

Sivaiah Technologies Inc. is not responsible for loss of access, downtime, email interruption, data loss, domain expiry, hosting suspension, service disruption, or other consequences caused by non-payment.

11. Transfers, Exports, and Handover Work

Website transfers, hosting migrations, domain transfers, email migrations, account exports, file exports, database exports, backup preparation, documentation, credential handover, and similar transition services are billed separately unless they are expressly included in the applicable Statement of Work or written agreement.

Sivaiah Technologies Inc. may require payment of all outstanding amounts before providing transfer, export, migration, handover, or backup services.

12. Client Data After Cancellation

After cancellation or termination, Sivaiah Technologies Inc. may retain or delete client data, files, backups, accounts, websites, applications, email data, or project materials according to the applicable agreement, service schedule, operational practices, and legal requirements.

Clients are responsible for requesting any required exports, backups, migrations, or handover services before cancellation or termination takes effect.

Sivaiah Technologies Inc. is not responsible for retaining client data indefinitely after services end.

13. Chargebacks and Payment Disputes

If a client believes there is a billing error, the client should contact Sivaiah Technologies Inc. before initiating a chargeback or payment dispute.

Sivaiah Technologies Inc. may suspend or restrict services while a payment dispute, chargeback, failed payment, or billing issue is unresolved.

Chargebacks do not cancel the client’s obligation to pay valid fees for services performed, services delivered, third-party costs, or amounts owed under an agreement.

14. No Guarantee of Results

Unless expressly stated in a written agreement, Sivaiah Technologies Inc. does not guarantee specific business results, search engine rankings, website traffic, sales, leads, revenue, app store approval, email deliverability, user adoption, performance outcomes, or uninterrupted availability of third-party services.

A lack of expected business results does not create a right to a refund.

15. How to Cancel

Cancellation requests should include the client’s name, business name, service being cancelled, and any relevant project or account details.

16. Changes to this Policy

Sivaiah Technologies Inc. may update this Refund and Cancellation Policy from time to time. The updated version will be posted with a revised “last updated” date.

Continued use of the services after an update means you accept the updated policy.
